Creditors, or any business that is owed money, can sometimes inadvertently fall under the FDCPA's guidelines. The Federal Trade Commission (FTC) and the Consumer Financial Protection Bureau (CFPB) have made this fact clear through guidance, enforcement actions and lawsuits.
If your business collecting its own debt under another business name as the first party creditor you may be subject to the FDCPA regulations. Section 803 (a) of the FDCPA regulations further provides that the definition of a debt collector includes "any creditor who, in the process of collecting his own debts, uses any name other than his own which would indicate that a third person is collecting or attempting to collect such debts".

New Consumer Tools Explain HIPAA Right to Access Health Information - The Office of Civil Rights previously released some guidance regarding individuals rights to access their health information. This is yet another area that poses challenges for healthcare staff when faced with a request from a patient to view their records. OCR "teamed up" with the HHS Office of the National Coordinator for Health IT and created easy to understand tools, videos, an infographic and illustrated fact sheet. As we have shared with you in recent posts, the HHS Office for Civil Rights (OCR) has been working on the implementation roll out to begin auditing Covered Entities (CEs) and their Business Associates (BAs) to gauge ongoing compliance with the Privacy, Security & Breach Notification Rules. During the second phase, the OCR began a verification process to gather the organization's contact information and business address. (These verification communications from the OCR will be sent in email format and they expect CEs and BAs to check their SPAM or junk folders for these emails.) (OSOCARudit@hhs.gov)
